These Terms of Service govern access to and use of Menulyn, including our website, restaurant admin dashboard, customer ordering pages, QR menu pages, table booking tools, mobile applications, waiter and kitchen workflows, kiosk ordering features, communication tools, integrations, and related services. By accessing or using Menulyn, creating an account, subscribing, managing a restaurant, placing an order, or using any related feature, you agree to be bound by these Terms.
If you are using Menulyn on behalf of a company, restaurant, hotel, café, group, partnership, or other organization, you confirm that you have authority to accept these Terms on behalf of that organization. If you do not agree to these Terms, you must not access or use Menulyn.
Menulyn is a restaurant software-as-a-service platform designed to help food and hospitality businesses manage digital menus, QR menus, online ordering, dine-in orders, pickup, delivery, table bookings, staff workflows, customer communication, restaurant settings, reporting, and related operations from web and mobile tools.
Menulyn provides technology tools. Restaurants remain responsible for their own food preparation, pricing, menu accuracy, tax compliance, customer service, delivery operations, staff management, legal compliance, and business decisions.
To use certain Menulyn services, you may need to create an account or be invited as a restaurant owner, manager, staff member, cashier, waiter, kitchen user, branch user, partner, or customer. You agree to provide accurate, current, and complete information and to keep that information updated.
Restaurants are responsible for all content they create, upload, publish, or display through Menulyn, including restaurant names, logos, images, descriptions, menus, item names, prices, taxes, discounts, modifiers, allergens, ingredients, preparation times, opening hours, delivery zones, booking availability, policies, and promotional messages.
You confirm that you have the rights and permissions needed to use any content uploaded to Menulyn. You must not publish misleading prices, unlawful goods or services, unsafe food claims, infringing images, deceptive promotions, or content that violates applicable laws or third-party rights.
Menulyn may help restaurants receive and manage orders, bookings, and customer requests. Restaurants are responsible for accepting, rejecting, preparing, fulfilling, updating, and completing orders and bookings in line with their own operations and applicable laws.
Menulyn may offer subscriptions, setup services, add-ons, integrations, custom domain services, implementation support, or other paid services. Billing may be monthly, annual, one-time, usage-based, or as otherwise agreed. Prices may be displayed in Kenyan Shillings or another supported currency depending on your region and billing arrangement.
You agree to pay all applicable fees, taxes, and charges when due. Failure to pay may result in suspension, downgrade, restriction, or termination of access. Unless otherwise stated in writing, subscription fees are charged in advance and renew automatically for the selected billing period.
Third-party payment processors may handle payment collection. Menulyn does not intentionally store full card details where a third-party processor is used. Refunds, billing corrections, and cancellations are handled according to our applicable Refund Policy, subscription rules, and any written agreement with you.
Menulyn may offer free trials, promotional access, early-access tools, or beta features. These may be changed, withdrawn, limited, or ended at any time. Beta or experimental features may be incomplete, unstable, or subject to change, and should not be relied on as guaranteed production features unless confirmed in writing.
You must not use Menulyn to:
Menulyn may integrate with third-party services such as payment gateways, SMS providers, email providers, WhatsApp tools, maps, analytics, domain providers, delivery partners, tax tools, or hosting infrastructure. Your use of third-party services may be subject to separate terms, charges, availability, and privacy practices.
Menulyn is not responsible for outages, delays, pricing changes, failed transactions, delivery issues, data errors, or policy changes caused by third-party services outside our control.
Menulyn handles personal and business data according to our Privacy Policy and applicable data protection laws. Depending on how you use the platform, data may include restaurant account data, staff information, customer details, orders, bookings, payment references, device information, support messages, and usage logs.
We use reasonable technical and organizational measures to protect the platform. However, no system can be guaranteed to be fully secure or uninterrupted. Restaurants are responsible for managing staff access, using strong passwords, limiting permissions, and complying with data protection obligations for customer data they collect or process through Menulyn.
Menulyn, including its software, interfaces, workflows, source code, design, documentation, logos, brand assets, templates, and platform materials, is owned by Menulyn, FortyHives, or their licensors and is protected by intellectual property laws. These Terms do not transfer ownership of Menulyn technology to you.
Restaurants retain ownership of their own business names, logos, menu content, food images, descriptions, pricing, and customer-facing content. You grant Menulyn a limited, non-exclusive, worldwide license to host, store, process, transmit, display, and use that content only as needed to provide, secure, support, and improve the service.
We aim to provide a reliable service, but Menulyn may occasionally be unavailable due to maintenance, updates, internet issues, hosting interruptions, third-party service failures, security incidents, or events beyond our control. We may modify, suspend, or discontinue features where needed for security, legal, operational, or product reasons.
Restaurants should maintain reasonable backup processes for critical business information and should not rely on Menulyn as the only record of important operational, tax, accounting, or compliance data.
We may suspend, restrict, or terminate your account or access to Menulyn if you breach these Terms, fail to pay fees, misuse the platform, create security risks, violate applicable laws, infringe third-party rights, abuse customers or staff, or use the platform in a way that may harm Menulyn, other users, or the public.
You may stop using Menulyn or request account closure through official support channels. Certain data may be retained where required for legal, accounting, security, dispute-resolution, backup, or legitimate business purposes.
Menulyn is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, error-free performance, and guaranteed business results.
Menulyn does not guarantee that using the platform will increase revenue, prevent all errors, eliminate operational problems, satisfy all tax or regulatory requirements, or replace professional accounting, legal, tax, food safety, or business advice.
To the maximum extent permitted by law, Menulyn, FortyHives, and their directors, employees, contractors, agents, partners, and licensors will not be liable for indirect, incidental, special, consequential, punitive, exemplary, or loss-of-profit damages, including lost revenue, lost orders, lost data, loss of goodwill, business interruption, food preparation errors, delivery delays, payment processor failures, or operational losses.
Where liability cannot be excluded, our total liability for claims relating to Menulyn will be limited to the amount you paid to Menulyn for the service giving rise to the claim during the three months immediately before the event giving rise to the claim, unless applicable law requires a different limit.
You agree to defend, indemnify, and hold harmless Menulyn, FortyHives, and their directors, employees, contractors, agents, partners, and licensors from claims, losses, damages, liabilities, costs, and expenses arising from your use of Menulyn, your restaurant content, your orders or bookings, your breach of these Terms, your violation of law, your misuse of customer data, or your infringement of third-party rights.
We may update Menulyn features, pricing, policies, modules, or these Terms from time to time. Where practical, we may notify users of material changes through the website, dashboard, email, WhatsApp, or other channels. Continued use of Menulyn after changes become effective means you accept the updated Terms.
These Terms are governed by the laws of Kenya, unless a separate written agreement states otherwise. The parties will first attempt to resolve disputes in good faith through informal communication. If a dispute cannot be resolved informally, it will be handled by courts with competent jurisdiction in Kenya, unless another dispute-resolution process is required by applicable law or agreed in writing.

The restaurant is responsible for keeping menu items, prices, images, taxes, modifiers, availability, and order settings accurate. Menulyn provides the tools to manage and display that information.
Menulyn can support delivery workflows, but restaurants remain responsible for their own delivery operations unless there is a separate written agreement with a delivery provider or service partner.
Yes. Menulyn may suspend or restrict access for non-payment, security concerns, misuse, unlawful activity, abuse, or breach of these Terms.
No. These Terms are a strong SaaS terms template, but you should have them reviewed by a qualified lawyer before publishing, especially if Menulyn will operate across multiple countries.
